The law was adopted by the Verkhovna Rada of Ukraine on September 18, 2012 (Reg. No. 8484). The law amends paragraph one of part four of article 33 of the Law “On Labour Safety”, substituting the words “central body of executive power for supervision of labour safety” with “central body of executive power that implements state policy in the sphere of labour safety”.
The President of Ukraine noted that current version of the law contradicts the laws “On the Cabinet of Ministers of Ukraine” and “On Central Bodies of Executive Power”.
The Head of the state suggests refining the law through clothing the central body of executive power with authority to perform lawmaking activities, particularly developing different regulatory legal acts pertaining to the sphere of labour safety, as well as amending such acts or making appropriate suggestions to be considered by the central body of executive power. The Head of the state believes that it contributes to forming state policy in the abovementioned sphere.
Thereat, the President suggests the new version of paragraph four of part four of article 33 of the Law “On Labour Protection”.
The President suggests also reconsidering the provision of paragraph five of part four of article 33 of the Law “On Labour Safety” and exclude from the list of powers of the central executive body implementing state policy in the sphere of labour safety, the authority to coordinate activities of ministries and other central executive bodies.
The Head of the state noted that current provisions of part four of article 43 of the Law “On Labour Protection” remained unaddressed.
The President of Ukraine suggests ensuring consistent and comprehensive approach to settling the issue of labour safety management while amending the Law “On Labour Safety”.
The Committee members agreed with the remarks of the President of Ukraine and suggest taking into account his proposals.
